IMPORTANT NOTE ON TAX DEDUCTION (TDS)
As required by the Income Tax Act, Cyber Alliance India will deduct TDS (Tax Deducted at Source) from all commission payments exceeding the statutory threshold. All commission figures below are the Gross Commission before TDS.
OUR COMMITMENT TO TRANSPARENCY
We assure you that all referral commissions are paid directly by Cyber Alliance India as a part of our growth investment. We do not inflate project prices or fees to cover referral payments, ensuring your referred client always receives the most competitive quote.
1. Commission Eligibility and Tiers
The Total Project Payment is defined as the final, agreed-upon project cost for services rendered. It excludes any amount collected for Goods and Services Tax (GST), other government taxes/levies, third-party software/hosting fees, or subsequent Annual Maintenance Contract (AMC) fees.
Referral commissions are calculated as a percentage of the Total Project Payment received from the client.
A successful client referral is finalised when a referred prospect executes the agreement and renders the Total Project Payment.

Calculation Example: A successful project of ₹8,00,000 falls in the 12.5% tier, generating a Gross Commission of ₹1,00,000 (since it hits the standard maximum payout).
Maximum Payout (Standard Tier): ₹1,00,000 per successful referral. The commission calculated by the percentage will not exceed this limit.
Premium Referral Tier
An increased, flat commission rate [Regardless of Project Value] is offered for long-standing company relationships or highly successful referrers.

2. Payment and General Conditions

| Requirement & Forfeiture | Referrers must provide all necessary account details and a valid PAN card/Tax ID within 15 days of the client's final payment for the referred project. Failure to provide these details within this timeframe will result in the forfeiture of the commission. |
3. Referral Validity and Exclusions
Commission is applicable only for referrals that lead to projects in Website/Webapp Development and Native Application Development.

| Referral Conflict | In the event a prospective client is referred by more than one person, the commission will be awarded to the referrer whose submission was formally acknowledged first by Cyber Alliance India, as determined by the date/time stamp of the submitted communication. |
| Referral Validity (Lock-in) | A submitted referral is valid for a period of One Week from the date of our formal acknowledgment. If the client does not finalize the project within this time, the referral expires. |
| Existing Clients | Commission is paid solely for new client acquisitions. If a referred new client has multiple simultaneous projects, commission is awarded exclusively for one initial project, as designated by Cyber Alliance India. All other current and subsequent projects with that client are ineligible. |
| Self-Referral | Individuals are ineligible to receive commission for referring their own company, a company they own/partner in, or a project where they are the primary direct contact/decision-maker. |
4. Legal and Administrative
Independent Contractor Status
The referrer acts solely as an independent contractor. This policy does not establish an employment relationship, partnership, or joint venture. Referrers have no authority to bind Cyber Alliance India to any contract.
Tax Deduction and Responsibility (TDS)
- Cyber Alliance India is mandated to deduct Tax Deducted at Source (TDS) from the gross commission payment, as per the relevant sections of the Indian Income Tax Act, 1961 (e.g., Section 194H or 194J).
- The payment made will be the gross commission less the applicable TDS.
- The referrer is solely responsible for their final income tax, GST, and other local, state, and federal taxes on the gross commission income.
- A valid PAN card/Tax ID must be provided for payment processing and for the company to issue the necessary TDS certificate (Form 16A) for the referrer to claim credit.
Right to Modify and Governing Law
- Cyber Alliance India reserves the right to review, amend, or terminate this policy, including rates and criteria, at any time without prior notice. Commission eligibility is determined by the policy in effect on the date the client's project advance is successfully received.
- This policy shall be governed by the laws of India. The Courts in New Delhi shall have exclusive jurisdiction over any disputes arising under this policy.
